Brilliant Harvest, Inc. ("Brilliant Harvest," "we," "us," or "our") is a precision agriculture technology company headquartered in Portland, Oregon. We are committed to protecting the privacy and security of the personal information and farm data entrusted to us by our users. This Privacy Policy explains what data we collect, why we collect it, how we use and share it, and what rights you have with respect to your information.
This Privacy Policy applies to all users of the Brilliant Harvest platform, including the web application at brilliantforward.com, our mobile applications, our APIs, and any related services (collectively, the "Services"). By using our Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use our Services.
When you create an account with Brilliant Harvest, we collect your name, email address, phone number, mailing address, and account credentials (username and hashed password). If you are registering on behalf of a farm operation or business entity, we also collect the name and address of that entity. This information is necessary to provide you with access to the Services, communicate with you about your account, and comply with applicable legal requirements.
The core function of the Brilliant Harvest platform involves collecting, processing, and storing agricultural operational data. This includes but is not limited to: field boundaries, coordinates, and acreage; soil sampling results and fertility levels; planting dates, variety selections, and seed populations; crop protection and fertilizer application records; yield monitor data and harvest records; irrigation scheduling and application records; sensor data from IoT devices including soil moisture sensors, weather stations, and environmental monitors; equipment telematics data including GPS tracks, engine hours, and fuel consumption; and agronomic observation records including crop scouting notes and images.
We consider farm operational data to be owned by you, the user who created or uploaded it. We process this data as a service provider acting on your behalf. We do not sell your identifiable farm operational data to third parties, and we do not use it for purposes other than delivering and improving the Services to you, as described in Section 3.
When you use our web application or mobile apps, we automatically collect technical information including your IP address, browser type and version, operating system, device identifiers, pages accessed, time spent on pages, referring URLs, and error logs. This technical data is used to operate, maintain, and improve the reliability and performance of our Services and to diagnose technical problems.
If you contact us through support channels, email, or our in-platform messaging system, we retain records of those communications, including your contact information and the content of our exchanges. This information is used to respond to your inquiries and maintain service quality records.
If you subscribe to a paid tier of the Brilliant Harvest platform, payment processing is handled by our third-party payment processor, Stripe, Inc. We do not store complete credit card numbers on our servers. We retain transaction records including subscription tier, payment amount, and payment dates for billing and accounting purposes.
We use cookies and similar tracking technologies to authenticate users, maintain session state, remember preferences, and collect analytics data. For a detailed description of the cookies we use and how to control them, please see our Cookie Policy.
We collect information through several channels:
Direct submission: You provide information directly when you register for an account, complete your farm profile, upload data files, enter records manually, or contact our support team.
Automated device data: Information is collected automatically from connected IoT devices, equipment telematics systems, and mobile apps that you have authorized to send data to our platform.
Third-party integrations: When you authorize integrations with third-party services — such as connecting your John Deere Operations Center account, Climate FieldView subscription, or soil sampling laboratory portal — we receive data from those services as permitted by their terms and your authorization.
Public data sources: We supplement your farm data with publicly available data including USDA soil survey data, NOAA weather records, USGS topographic data, and satellite imagery from public sources.
Providing the Services: We use your information primarily to operate the Brilliant Harvest platform — to store and organize your farm data, generate analytics and recommendations, create prescription maps, and provide the full range of features described in our platform documentation.
Improving the Services: We analyze aggregated and de-identified usage patterns and anonymized agronomic data to improve the accuracy of our models, the usability of our interface, and the reliability of our infrastructure. Where we use farm data for model improvement, we apply aggregation and de-identification procedures to ensure that individual farms cannot be identified from the data used in model training.
Customer support: We use your contact and account information to respond to support requests, diagnose technical issues, and communicate about service changes or outages.
Security and fraud prevention: We use technical data including IP addresses, login patterns, and device identifiers to detect unauthorized access attempts, prevent fraud, and protect the security of our platform and users.
Legal compliance: We use and retain information as necessary to comply with applicable laws, respond to lawful requests from public authorities, and enforce our Terms of Service.
Marketing and communications: With your consent, we may use your contact information to send product updates, educational content, and promotional communications. You may unsubscribe from marketing communications at any time using the unsubscribe link in any email or by contacting us directly.
We do not sell your personal data. We do not sell, rent, or lease your personal information or identifiable farm operational data to third parties for their commercial purposes.
Service providers: We share information with trusted third-party service providers who assist us in delivering the Services. These providers include cloud infrastructure providers (Amazon Web Services), payment processors (Stripe), customer support software providers, email delivery services, and analytics platforms. All service providers are contractually bound to use data only as directed by us and to maintain appropriate security standards.
Authorized integrations: When you authorize a third-party integration through our platform — such as connecting an equipment telematics provider or a soil sampling laboratory — we share data with that third party as necessary to enable the integration and as directed by you.
Aggregated research: We may share aggregated, de-identified data with research partners, agricultural universities, and government agencies for the purpose of advancing agronomic science and sustainable farming practices. This data cannot be used to identify individual farms or users.
Legal requirements: We may disclose information when required to do so by applicable law, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect the safety of any person, to address fraud or security threats, or to protect our legal rights.
Business transfers: In the event of a merger, acquisition, or sale of all or substantially all of our assets, user information may be transferred to the acquiring entity, subject to the same privacy protections described in this policy.
We retain your personal information and farm data for as long as your account is active or as necessary to provide the Services. If you close your account, we will delete or anonymize your personal information and farm operational data within ninety days, except where retention is required by law or legitimate business purposes such as fraud prevention, dispute resolution, or compliance with legal obligations.
Certain technical logs and aggregated analytics data may be retained for longer periods as part of our standard system operations and security practices. Such retained data is de-identified and cannot be linked back to your account.
We implement comprehensive technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, or destruction. Our security practices include encryption of data in transit using TLS 1.2 or higher, encryption of sensitive data at rest using AES-256, access controls limiting employee access to personal data on a need-to-know basis, multi-factor authentication requirements for platform access, regular security assessments and penetration testing, and monitoring for unauthorized access attempts.
Despite these measures, no data transmission over the internet or data storage system can be guaranteed to be 100 percent secure. If you believe your account security has been compromised, please contact us immediately at security@brilliantforward.com.
We respect your rights regarding your personal information and farm data. Depending on your location, you may have the following rights:
Access: You may request a copy of the personal information we hold about you and a summary of your farm data at any time through your account settings or by contacting us.
Correction: If any information we hold about you is inaccurate, you have the right to request correction. Most profile and account information can be corrected directly through your account settings.
Deletion: You may request deletion of your personal information and farm data. We will process deletion requests within thirty days, subject to any legal retention obligations that apply.
Portability: You have the right to receive your farm data in a machine-readable format suitable for transfer to another service. We support export in standard formats including CSV, GeoJSON, and ADAPT-compatible formats. You can initiate a data export at any time from your account settings.
Opt-out of marketing: You may opt out of marketing communications at any time. This will not affect transactional communications necessary for the operation of your account.
To exercise any of these rights, contact us at privacy@brilliantforward.com. We will respond to all requests within thirty days.
The Brilliant Harvest platform is not directed to individuals under the age of 18, and we do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected information from a child under 18, we will take steps to delete that information promptly.
Our platform and website may contain links to third-party websites and services. This Privacy Policy does not apply to those third-party sites, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes by email or through a prominent notice on our platform at least thirty days before the changes take effect. Your continued use of the Services after the effective date of any updated policy constitutes your acceptance of the changes.
